1. Acceptance of terms
These Terms of Service ("Terms") form a binding agreement between you and BidPilot ("we", "our", "us") governing your use of our website and AI-powered Amazon advertising automation services (the "Service"). By creating an account or using the Service, you agree to these Terms. If you are using the Service on behalf of a company, you represent that you are authorized to bind that company.
2. The Service
BidPilot provides tools that help sellers, vendors and agencies manage Amazon advertising, including bid optimization, keyword and targeting discovery, campaign structuring, dayparting, reporting and related AI-assisted features. The Service is a decision-support and automation aid: advertising results depend on many factors outside our control, and we make no guarantee of any specific sales, ACoS, ranking or return-on-ad-spend outcome.
3. Accounts and eligibility
- You must be at least 18 years old and legally able to enter contracts to use the Service.
- You must provide accurate registration information and keep it up to date.
- You are responsible for safeguarding your login credentials and for all activity under your account. Notify us immediately at support@bidpilot.online if you suspect unauthorized access.
- One account may be used by the individuals you authorize; sharing credentials publicly or reselling access is prohibited.
4. Amazon and third-party integrations
- Connecting your Amazon Seller or advertising account is optional but required for automation features. You authorize us to access advertising data through the Amazon Ads API on your behalf.
- You remain responsible for compliance with Amazon's own terms and advertising policies for your listings and campaigns.
- API availability, rate limits and data accuracy depend on Amazon and other third parties; we are not liable for interruptions or discrepancies originating from those services.
5. Plans, billing and refunds
- Paid plans are activated manually: you pay through a hosted payment link, and an administrator approves and activates your plan. There is no in-app card collection, no automatic billing, and no recurring charges.
- Once activated, your plan stays active until an administrator changes it — there are no billing periods, renewals, or automatic charges of any kind.
- To cancel or downgrade, contact support@bidpilot.online . If you simply stop paying, nothing is charged.
- Except where required by law, subscription fees are non-refundable. See our Cancellation & Refund Policy for full details. If you believe you were charged in error, contact support@bidpilot.online and we will review the case.
- We may change pricing with reasonable advance notice; the new price applies to new activations after the notice period.
6. Free trials
We may offer a free trial (currently 30 days). No payment details are required to start a trial, and nothing is charged when it ends — there is no automatic conversion to a paid plan. To continue with paid features after your trial, you pay through a hosted payment link and an administrator activates your plan. When a trial expires without payment, dashboard access is gated until you upgrade. Trial features may be limited.
7. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose or in violation of Amazon's policies;
- Attempt to gain unauthorized access to the Service, other accounts or our systems;
- Reverse-engineer, copy or resell the Service, or use it to build a competing product;
- Interfere with or disrupt the Service, including through automated scraping beyond documented API usage;
- Upload malicious code or infringing content.
We may suspend or terminate accounts that violate this section.
8. Your data
You retain all rights to the data you provide or that we fetch from your connected accounts ("Customer Data"). You grant us a limited license to process Customer Data solely to provide and improve the Service. We do not use your Customer Data to train shared models in a way that exposes it to other customers.
9. Intellectual property
The Service, including its software, design, branding and content, is owned by BidPilot and protected by intellectual property laws. These Terms grant you a limited, non-exclusive, non-transferable license to use the Service during your subscription. All rights not expressly granted are reserved.
10. Service availability and disclaimers
We aim for high availability but do not warrant that the Service will be uninterrupted, error-free or meet every requirement. The Service is provided "as is" and "as available" to the maximum extent permitted by law, without warranties of any kind, express or implied.
11. Limitation of liability
To the maximum extent permitted by law, BidPilot will not be liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, data or advertising spend. Our total liability for any claim arising from the Service will not exceed the fees you paid to us in the twelve (12) months before the claim arose.
12. Indemnification
You agree to indemnify and hold harmless BidPilot against claims, damages and expenses arising from your use of the Service in violation of these Terms or of applicable law, including your advertising content and campaigns.
13. Termination and suspension
You may stop using the Service and delete your account at any time. We may suspend or terminate your access with notice for breach of these Terms, non-payment, or as required by law or by Amazon's API policies. On termination, your license to use the Service ends; sections that by their nature should survive (including payment obligations, IP, disclaimers and liability limits) will survive.
14. Changes to these Terms
We may update these Terms; we will post the revised version here and update the date. Material changes will be notified in advance where reasonable. Continued use of the Service after the changes take effect constitutes acceptance.
15. Governing law
These Terms are governed by the laws applicable in the jurisdiction where the Service is operated, without regard to conflict-of-law principles. Any disputes will be resolved through good-faith negotiation first, and otherwise in the competent courts of that jurisdiction.
